Shekinah Fellowship's Brush With Copy Right Violation.

I once posted a video of the Shekinah Fellowship Choir and was told that it was a copy right violation.

It was not.

Any church service singing songs is not in violation of any copy right law.

I took it down to be safe but soon enough put it back up after doing a bit of research.

It's not a complete solution, but YouTube is going to begin stepping up to defend select videos in court on fair use terms, including covering court costs.

 Will this help stem the tide of bad DMCA takedown requests, or just help the select few YouTube doesn't want to lose?

 With approval of the video creators, we’ll keep the videos live on YouTube in the U.S., feature them in the YouTube Copyright Center as strong examples of fair use, and cover the cost of any copyright lawsuits brought against them. ...

 In addition to protecting the individual creator, this program could, over time, create a “demo reel” that will help the YouTube community and copyright owners alike better understand what fair use looks like online and develop best practices as a community.

 It has a "religious service exemption," there is no infringement of copyright. (U.S. Copyright Law (Section 110[3])

 This video is uploaded to Youtube for the preservation of the historical record of Shekinah Fellowship.

 Shekinah Fellowship no longer exist and Reverend Brant Baker has passed on.

 At one time Shekinah Fellowship was the only fellowship named this.

 But now if you check Google there are thousands of others.

 Brant Baker and Shekinah Fellowship had an influence on many and the mere fact that his name of Shekinah Fellowship is all over the place speaks volumes...

The religious service exemption of the U.S. Copyright Law (Section 110[3]) is probably the most important part of the law for churches, because it provides that:

 “performance of a non-dramatic literary or musical work or of a dramatico-musical work of a religious nature or display of a work, in the course of services at a place of worship or other religious assembly” shall not constitute infringement of copyright.

 In other words, you do not have to get permission from the copyright owner or pay royalties to perform music or display the lyrics of a work in a religious service.

 This applies to the “performance” and “display” rights, which are only two of the six rights of the copyright owner.
